End User License Agreement (EULA) – EasyUpscale

Provider: Daniel Mazura, Company ID (IČO) 19809735, Běchovická 612, 250 92 Šestajovice, Czech Republic, contact: info@easyupscale.cz. The license is sold by Polar on the website (see section 7); the Microsoft Store only distributes the App (see section 10).

This is an English translation for convenience. If the Czech version differs, the Czech version prevails, except where the law of your country gives you stronger protection.

1. License

The Provider grants you a non-exclusive, non-transferable license to install and use the EasyUpscale application (the "App").

  • Without a license key you may use the App free of charge and without a time limit. The preview in the App shows a lighter watermark; saved files carry a stronger watermark. You may not remove, cover or circumvent the watermark.
  • With a valid license key your results have no watermark and may also be used commercially. The license does not expire. One key can be activated on at most one device at a time. The key is personal; you may not publish or share it. You can remove the activation in the App and use the key on another device.
  • The Provider may deactivate a key if it was obtained in breach of these terms, was published or misused, or if the payment was refunded.

2. Your images and results

Your images and results remain your property. The App processes them only on your computer and does not send them to the Provider or to third parties. You are responsible for having the right to use the images you process.

3. Restrictions

You may not copy or distribute the App outside the scope of this license, resell it, remove copyright notices, or circumvent the licensing mechanisms (including the watermark and license key verification). Statutory rights that cannot be excluded by contract are not affected.

4. Third-party components

The App contains open-source components (among others Qt/PySide6 under LGPL-3.0, ONNX Runtime, OpenCV, Real-ESRGAN, SwinIR). Their licenses are listed in the file THIRD-PARTY-NOTICES.md and in the "About" window. This agreement does not limit any rights those licenses give you to their own parts, including the right to replace the Qt libraries with your own version (in line with the LGPL they are shipped as separate files).

5. Nature of the results and liability

AI upscaling creates new detail that was not present in the original image. The result may not faithfully match reality and is not suitable as evidence or for any purpose where exact fidelity to the original is required.

The Provider is liable for damage in accordance with the law. Liability for damage caused intentionally or through gross negligence, for harm to health, and in other cases where the law does not allow it cannot be excluded or limited. Otherwise the Provider is not liable for lost profit or indirect damage, and its liability is limited to the amount you paid for the license. For consumers this limitation applies only to the extent permitted by law.

6. Rights in case of defects

Consumers keep their statutory rights regarding defective digital content. The App must match what is described on the website and in the App. If the App does not work as it should, write to info@easyupscale.cz and we will fix the defect (with a fix or a new version). If the remedy is not satisfactory, you are entitled to a price reduction or to withdraw from the contract as provided by law.

7. Payment, withdrawal and refunds

The license is sold and payment is processed by Polar (Polar Software Inc., the "Seller"), which is your contractual partner for the purchase and issues the receipt. The Seller's terms also apply to the purchase (https://polar.sh/legal/terms).

Right of withdrawal. A consumer may withdraw from the contract within 14 days of the purchase without giving a reason and gets the full price back. The procedure is in the Refund Policy. You can try the App free of charge before buying (results carry a watermark).

The cases in which we refund are described in the Refund Policy. Beyond what the law requires, the Provider or the Seller may also refund at their discretion. After a refund, the key is deactivated.

The Microsoft Store. The license is not sold in the Microsoft Store. If you installed the App from the Store, you buy the license on our website from Polar and activate it with the key in the App.

8. Changes to the App and these terms

We may improve and fix the App. We may change these terms; a change does not apply to a license you have already paid for, for the version you have, if it would put you in a worse position.

9. Termination

The license ends if you breach this agreement. After termination you must uninstall the App. Termination does not affect your statutory rights as a consumer.

10. Distribution through the Microsoft Store

If you installed the App from the Microsoft Store, Microsoft operates the store and handles the download and updates. This agreement is then the license terms of the App and replaces the standard application license terms of the Store, to the extent the Store allows custom terms. The App is free to install; the license is bought on the website (section 7). Microsoft is not a party to this agreement and is not responsible for the App, its support or its maintenance. 11. Governing law and disputes

This agreement is governed by the law of the Czech Republic. If you are a consumer living in another country, you keep the protection given to you by the mandatory provisions of the law of your country.

If you have a dispute with us that cannot be resolved directly (info@easyupscale.cz), you can as a consumer turn to an out-of-court dispute resolution body; in the Czech Republic this is the Czech Trade Inspection Authority (https://www.coi.cz).
